LEGISLATIVE PROPOSAL FOR TREASURY AUTHORITY

TO PURCHASE MORTGAGE-RELATED ASSETS

Section 1. Short Title.

This Act may be cited as ____________________.

Sec. 2. Purchases of Mortgage-Related Assets.

(a) Authority to Purchase.–The Secretary is authorized to purchase, and to make and fund commitments to purchase, on such terms and conditions as determined by the Secretary, mortgage-related assets from any financial institution having its headquarters in the United States.

(b) Necessary Actions.–The Secretary is authorized to take such actions as the Secretary deems necessary to carry out the authorities in this Act, including, without limitation:

(1) appointing such employees as may be required to carry out the authorities in this Act and defining their duties;

(2) entering into contracts, including contracts for services authorized by section 3109 of title 5, United States Code, without regard to any other provision of law regarding public contracts;

(3) designating financial institutions as financial agents of the Government, and they shall perform all such reasonable duties related to this Act as financial agents of the Government as may be required of them;

(4) establishing vehicles that are authorized, subject to supervision by the Secretary, to purchase mortgage-related assets and issue obligations; and

(5) issuing such regulations and other guidance as may be necessary or appropriate to define terms or carry out the authorities of this Act.

Sec. 3. Considerations.

In exercising the authorities granted in this Act, the Secretary shall take into consideration means for–

(1) providing stability or preventing disruption to the financial markets or banking system; and

(2) protecting the taxpayer.

Sec. 4. Reports to Congress.

Within three months of the first exercise of the authority granted in section 2(a), and semiannually thereafter, the Secretary shall report to the Committees on the Budget, Financial Services, and Ways and Means of the House of Representatives and the Committees on the Budget, Finance, and Banking, Housing, and Urban Affairs of the Senate with respect to the authorities exercised under this Act and the considerations required by section 3.

Sec. 5. Rights; Management; Sale of Mortgage-Related Assets.

(a) Exercise of Rights.–The Secretary may, at any time, exercise any rights received in connection with mortgage-related assets purchased under this Act.

(b) Management of Mortgage-Related Assets.–The Secretary shall have authority to manage mortgage-related assets purchased under this Act, including revenues and portfolio risks therefrom.

(c) Sale of Mortgage-Related Assets.–The Secretary may, at any time, upon terms and conditions and at prices determined by the Secretary, sell, or enter into securities loans, repurchase transactions or other financial transactions in regard to, any mortgage-related asset purchased under this Act.

(d) Application of Sunset to Mortgage-Related Assets.–The authority of the Secretary to hold any mortgage-related asset purchased under this Act before the termination date in section 9, or to purchase or fund the purchase of a mortgage-related asset under a commitment entered into before the termination date in section 9, is not subject to the provisions of section 9.

Sec. 6. Maximum Amount of Authorized Purchases.

The Secretary’s authority to purchase mortgage-related assets under this Act shall be limited to $700,000,000,000 outstanding at any one time

Sec. 7. Funding.

For the purpose of the authorities granted in this Act, and for the costs of administering those authorities, the Secretary may use the proceeds of the sale of any securities issued under chapter 31 of title 31, United States Code, and the purposes for which securities may be issued under chapter 31 of title 31, United States Code, are extended to include actions authorized by this Act, including the payment of administrative expenses. Any funds expended for actions authorized by this Act, including the payment of administrative expenses, shall be deemed appropriated at the time of such expenditure.

Sec. 8. Review.

Decisions by the Secretary pursuant to the authority of this Act are non-reviewable and committed to agency discretion, and may not be reviewed by any court of law or any administrative agency.

Sec. 9. Termination of Authority.

The authorities under this Act, with the exception of authorities granted in sections 2(b)(5), 5 and 7, shall terminate two years from the date of enactment of this Act.

Sec. 10. Increase in Statutory Limit on the Public Debt.

Subsection (b) of section 3101 of title 31, United States Code, is amended by striking out the dollar limitation contained in such subsection and inserting in lieu thereof $11,315,000,000,000.

Sec. 11. Credit Reform.

The costs of purchases of mortgage-related assets made under section 2(a) of this Act shall be determined as provided under the Federal Credit Reform Act of 1990, as applicable.

Sec. 12. Definitions.

For purposes of this section, the following definitions shall apply:

(1) Mortgage-Related Assets.–The term “mortgage-related assets” means residential or commercial mortgages and any securities, obligations, or other instruments that are based on or related to such mortgages, that in each case was originated or issued on or before September 17, 2008.

(2) Secretary.–The term “Secretary” means the Secretary of the Treasury.

(3) United States.–The term “United States” means the States, territories, and possessions of the United States and the District of Columbia.

This woman is such a kiniving, shady, manipulating person. How dare her blaim this administration for the crisis we are in, and then to blame the republicans for the bill not being passed. Whoever believes that bull is as dumb as they come! Dont be stupid Americans, she is only blaming the Republicans so that Obama will get in office. She is playing with your minds!!! She set this all up so the republicans would get the blame! I was an independant but now that this has happened I will call myself a PROUD REPUBLICAN. How dare you play with our minds NANCY!     You CAN NOT vote YES to the Bailout Proposal. You MUST VOTE NO!!! It is not only wrong but it leads to Socialism. Don’t permit the United States Federal Government to Nationalize Financial Institutions!!! You should seriously look at suspending the Mark-To-Market Accounting Instrument which is killing Banks!!!!! I voted for you and you are a conservative. Not a liberal!! You hopefully are not a socialist either!!!
    Here are some alternatives to jump start the economy: 1st bring back Income Averaging, 2nd allow main street to purchase up to 4 homes and write of the mortgage interest, 3rd suspend Mark-To-Market Account Instrument, 4th permit main street to deduct more then 3K dollars on losses!!!

    Whenever Congress tries to fix problems it scares me to death! Many times the cure is worse than the disease. To help the poor and less fortunate, a noble intention surely, President Clinton and his administration put forth legislation to force banks to give loans to people who couldn´t afford to pay them back and the Fannie and Freddie were allowed to run amuck. PLEASE DO NOT SAY THAT THE ABUSES WERE CAUSED BY THE REPUBLICANS. I believe that all of you have extremely selective memories, especially at election time. It amazes me that any intelligent person can honestly believe that you can tax the rich and big business to the point that they will not look for other places to invest their money. Who but small and large business can offer the rest of us jobs? You talk about championing small business and rewarding businesses that stay here and employ our people. Wonderful! Then you turn around and tie their hands by proposing to raise corporate taxes (Ours are second highest in the world after Japan!)if Demos win the election and tie the hands of all businesses, regardless of size, with things like mark to market (SUSPEND IT NOW!)

    Some advice. (1). Stop pointing fingers. I´d like to send little mirrors to administration and the members of Congress and all voters. Everyone of us shares the blame. A little personal responsibility would go a long way!
    (2). Remember what Mary Poppins said: A spoon full of sugar helps the medicine go down. Stop having news conferences where all the faces are Demos or Republicans. (3) My mother always said GOD DOESN´T LIKE UGLY! Be civil. (4) Don´t try to play the stupid - an old family saying which means you know better but to achieve some end you say something you know is false. As any practicing Catholic knows, we believe AND HAVE ALWAYS BELIEVED that “life” begins at conception. Come on, Mrs. Pelosi! You must have been listening as closely as your candidate was in his church for 20 years.(5) Please ACTUALLY READ the bills being considered and try to anticipate their consequences before voting. Please insist upon it and tell all Congressmen and women to listen to their constituents and represent THEM. Ask them to do a better job at understanding the workings of bills and doing a better job of explaining it to us. Vote their consciences, even if they are not reelected.

    I do not admire your tactics during the wall street/economic crisis. I believe they were out of line and without substance. If you recall the republicans warned the Democrats that steps needed to be taken to prevent this crisis from happening. However, the democrats blocked this from happening. (This is proven because it is recorded on film which has been shown by Fox). Yet, you go on National television and rip apart the Busch Administration for the market crisis. Let me remind you it was largely the democrats who benefited greatly from the organizations that caused the mortgage crisis. Someday someone is going to have to explain the ethical behavior not to mention logic in giving high mortgages to people who can not afford to pay them. Also, it is the left wing organization ACORN supported by Obama and other democrats that is also at fault and causing voter registration fraud and possibly votes. The behavior of ACORN goes against our democracy and why should Americans have to support this type of organization with tax payers dollars when it causes such damage to our economy, establishment and reputation to our Nation. Your so worried about America not being respected around the world due to policies of the Bush Administration. Take a good look at what your left wing liberal organizations and fellow senators have done to the American economy. Its a joke to point fingers and put on such a rightous act when you support organizations and are guilty of blocking the very steps that would have prevented this crisis from happening. Barney Frank is guilty, Cox is guilty, etc. etc. and I hope there is an investigation and justice prevails. There is no doubt that there have been mistakes made by the Bush Administration but remember our country has been safe since 911. That is more than I can say if Obama is elected. By the way, I am an independent voter and I am not partial to one party but I have to speak the truth as I have seen it on film. Facts are facts.

    I am hoping America wakes up before November 4th. I hope they realize that if Obama is elected president he will take hard earned money from various individuals and hand it over to those who did not work for it. That is socialism. What elese can you call it? This was not what our ancestors had in mind for future generations. If he so admires socialistic policies he should move out of the United States and live elsewhere. It is not up to him to take money that belongs to people and decide that others should also benefit from it. That is called stealing. Charity comes from the heart not the demands of a goverment.
    If elected, Obama will dig us right into the ground financially and many Americans will be unhappy with his anti American policies. If he is elected Obama will surely be a one term president due to his idealogy. America may have to learn the hard way, but thankfully I will not be responsible for the outcome of an Obama Administration with a democrat congress and senate, not to mention a liberal media. I fear we are in for a rough ride because America has here eyes wide shut.

    Mrs. Pelosi, I have been a loyal democrat for all my 70 years. I can’t understand why you will not stand up against John McCain when he besmirches your value. He tells everyone what a war hero he was I challenge that, he was just a bad pilot. When they wanted to release him he declined. Yet as an officer his responsibility was to return and inform his commanding Officer of the enemys statusis that what he calls presidential ? Kinda makes you wonder how many extra of our warriors were slain to keep him comfortable. He could be our Manchurian Candidate… Watch out if he gets his fimger on the bomb.

    If this a consumer driven economy then why are the few rich people recieving the bailout money?
    Seems to me that if ou distributed it to the consumer they would (put it in the bank, buy a car,buy large ticket items, pay off toxic paper,stimulate the economy thru spending,cause manufacturing to eginte again)isn’t that the end result we are looking for.
    Is ther a law somewhere that prevents the american public to be denied having a part of the burden our government placed on us?
